  10. An Inter vivos Trust has detailed rules and conditions outlined in the trust deed (25 + pages), this is normally not the case with Testamentary Trusts (+- 2 pages), how can that be overcome.
  11. Do the same rules apply to Inter Vivos Trusts as to Mortis Causa Trusts, i.e. does a Mortis Causa trust have to have an independent Trustee, do the Trustees have to be registered with Sars, what is the ruling in terms of the Beneficial owner etc.
  12. Who may/may not act as Trustees of a Testamentary trust?

  14. Can the Trustees of a Testamentary Trust enter into a redistribution agreement?

About our speaker:

Phia van der Spuy is a Chartered Accountant with a Masters degree in Local and International Tax, a registered Fiduciary Practitioner of South Africa®, a Master Tax Practitioner (SA)™, a Trust and Estate Practitioner (TEP) and the founder of Trusteeze®, a professional trust practitioner.

She also holds a B.Com honours degree in Industrial Psychology.

Phia co-founded a company that digitised trust administration and accounting, called Trusteeze.

Her idea to digitise trust administration and accounting was born when she acted as a business coach for the Microsoft Bizspark program's technology startups.

Trusteeze is evolving and is becoming a digital solutions provider in the fiduciary space – a disrupter. The group has expanded internationally, and the group internationally is called WealthEeze. It operates from the Isle of Man.

Phia writes about trusts and estate planning in various national newspapers on a regular basis to educate and enlighten estate owners.

She also recently published the second edition of her book called “Demystifying Trusts in South Africa” to educate all role players in a trust.

She speaks at various conferences, on radio programs, television programs, professional bodies (such as the Financial Planning Institute and SAIPA) and is also a guest lecturer for universities on the topic of trusts and estate planning.

She is the examiner for the trust section for the Advanced Diploma in Estate and Trust Administration at the University of Free State.

Phia has received the FISA Chairperson’s Award 2020 for her contribution to the fiduciary industry.
